These terms and conditions (hereinafter referred to as the “Terms and Conditions”) apply between the company FETE IMPERIALE and any consumer (hereinafter referred to as “you”) placing an order on the website www. feteimperiale.fr (hereinafter referred to as the “Site”). Sales on the Site are exclusively aimed at consumers buying the items for their personal use, to the exclusion of any resale.
The Terms and Conditions may be changed at any time. The applicable version of the Terms and Conditions is the one available on the site at the time of your order.

2. ACCEPTING CONDITIONS
By checking the box “I accept the terms and conditions” before confirming your order, you acknowledge that you are familiar with the Terms and Conditions and that you accept them unconditionally.
To place an order, you need to be a competent adult or an emancipated minor. To place an order on the Site, you must select your chosen item, size and quantity, then click on “Add to basket”. You must have a customer account, which you can create at any time, online, on the Site. To proceed with any order, you must first read and agree to the Terms and Conditions by checking the box “I accept the terms and conditions”. Then click on “Order”. In accordance with article L122-1 of the French Consumer Code, FETE IMPERIALE can refuse to proceed with an order for any legitimate reason, including in particular if there is a dispute regarding payment for a previous order. Once the order has been confirmed and paid for, payment confirmation and an order confirmation will be sent to you by email. The order is then deemed to be complete. Once your order has been confirmed in this way, you can no longer change it on the Site. The prices shown on the Site are in Euros and are inclusive of all taxes and exclusive of delivery charges. FETE IMPERIALE can change the prices of items at any time. The prices applicable to each order are those shown on the Site when the order is placed. The total delivery costs for items are outlined in article 7. Details of the total owed by you will be shown on the “Confirmation” page summarising your order.
5. PAYMENT TERMS
5.1 Methods Payments are processed online, by providing the information requested on the relevant page of the Site, by: – bank card, Visa or Mastercard, – PayPal. FETE IMPERIALE reserves the right to suspend or cancel the order in the following circumstances: – your card issuer refuses to authorise the payment for any reason whatsoever – the payment for the order is incomplete, illegal or non-existent for any reason. It is understood that any fees that might be charged by the card issuer or by your bank for the transaction will be your responsibility. 5.2 Payment security The payment is processed via HSBC’s ElysNet secure online payment system. We will only keep the bank details that you have provided to fulfil our legal obligations. The information relating to your order will be processed by our bank, HSBC via its payment platform using an automated data processing system. This automated data processing system is designed to define a level of analysis of a transaction and combat bank card fraud.
5.3 Billing All bills will be available and can be downloaded and printed from the “My account/My orders” section as soon as your order has been dispatched. If the order has been dispatched in more than one delivery, you will have one bill for each delivery.
6. PRODUCT AVAILABILITY
Items are available for sale while stocks last. You will be informed of the availability of any item you want to buy before placing your Order. FETE IMPERIALE undertakes to keep the Site up-to-date regarding the availability of all the items for sale. If, after the payment and order confirmation email has been received, it appears as though the item is no longer available, FETE IMPERIALE will inform you by email as quickly as possible, in accordance with article L121-20-3 of the French Consumer Code. In accordance with article L121-20-3 of the French Consumer Code, if the item you have ordered is not available, you can claim: – a refund for your order within a maximum of thirty (30) days, or – the delivery of another similar product, of an equivalent quality and price.
Items are delivered to the following geographical areas, to the address provided when the order is placed: – Metropolitan France – European Union – United States of America, Canada, Monaco, Switzerland, Norway, Australia, Honk-Kong, Japan The total delivery costs will be shown before you confirm your order. The delivery costs depend on the delivery method chosen and are defined as follows: For a delivery to Metropolitan France: – Free standard delivery via Colissimo within two or three working days of dispatch. – Express delivery within 24 hours via UPS: delivery charge of 15 Euros including taxes. – Delivery within the city of Paris by coursier within 3 hours: delivery charge of 15 Euros. Possibility to deliver to the suburb, please contact us to find out about the terms and conditions of this delivery option at firstname.lastname@example.org. For deliveries outside Metropolitan France: – International standard delivery via Colissimo within 4 to 15 working days: delivery charge of 30 Euros. Delivery costs will be shown on the Site in the “Delivery Methods” page during the order is process, and on the “Confirmation” page summarising your order. FETE IMPERIALE undertakes to inform you of the delivery times and do everything it can to deliver the items ordered within the agreed times. If there is a problem with the delivery, FETE IMPERIALE undertakes to do everything it can to keep you informed of any delay to the delivery time. It is understood that: – The delivery times shown depend on stock availability – The delivery times shown start from the date on which the customer receives an order confirmation email.
8. LEGAL SAFEGUARDS
These specific articles only applies to France Metropolitan. You are protected by legal guaranties, including in particular the guarantee of compliance in accordance with articles L211-4 to L211-14 of the French Consumer Code and the guarantee against defaults in the item sold, in accordance with articles 1641 to 1648 of the French Civil Code.
9. RIGHT OF WITHDRAWAL
In accordance with articles L121-21 et seq. of the French Consumer Code, you have a right of withdrawal of fourteen (14) days, from the date on which the items ordered were delivered. If you exercise the right to use this right of withdrawal, you will be fully refunded for money paid for the items returned and accepted by customer services. You are responsible for the return postage costs. Before returning an item, you must write to the following address to inform us of your desire: email@example.com. You must then return the item to the following address: Fête Impériale 28 Rue du Roi de Sicile 75004 Paris – in their original packaging – without having worn them, in a state that means they can be marketed as new – accompanied by the delivery note received with the order. The refund will be processed within 14 days of receipt by FETE IMPERIALE of the returned items and after the return or returns in question has/have been accepted.
10. INTELLECTUAL PROPERTY
The Site belongs to FETE IMPERIALE, who own the related intellectual property rights. The Site and the information constituting the Site and its content, whatever its nature (text, photographs, images, sounds, graphic elements etc.) may be protected as intellectual property. All distinctive signs, including in particular trademarks and logos, are and remain the property of FETE IMPERIALE or of the owners of the relevant intellectual property rights. Recognising these exclusive rights to these signs, users of the Site are prohibited from using them for any purpose other than for the purposes of consulting the Site. Any use of the Site or all or part of the elements of which it is made up, other than that connected to consulting the Site, is prohibited without the explicit prior written agreement of the owners of the rights in question.
11. DATA CONFIDENTIALITY
We need your personal information in order to open your account, manage and track your order and, if applicable, send you offers by email if you have explicitly agreed to that in advance. In accordance with the French Data Protection law of 6 January 1978, you are entitled to access, correct and remove personal information about you. Given the technical restrictions in terms of IT and telecommunications related to using the Site, FETE IMPERIALE cannot be held responsible for any damage caused by a problem, beyond its control, with one or more stages involved in accessing the Site, the order process, payment or delivery tracking, caused in particular by the disadvantages inherent in using the Internet, such as a service interruption, external intrusion or the presence of computer viruses. Furthermore, FETE IMPERIALE cannot be held responsible if its obligations are not fulfilled, or not fulfilled properly, because of your own behaviour, because of the unpredictable, insurmountable involvement of a third party to the contract, or because of force majeure.
13. INTEGRALITY AND VALIDITY OF THE TERMS AND CONDITIONS
The Terms and Conditions and your order confirmation form a contractual whole that constitutes all of the agreements between the parties. If one or more of the provisions in the Terms and Conditions is declared invalid in full or in part, the other provisions will still be fully applicable. If necessary, the invalid provision will be renegotiated in good faith.
14. APPLICABLE LAW AND SETTLING DISPUTES
The Terms and Conditions are subject to French law. In the event of a dispute regarding the interpretation or execution of the Terms and Conditions, the French courts will have exclusive jurisdiction.
15. TAXES & DUTIES
Based on your shipping location: EU (European Union) or ROW (outside EU, included US, CA, AUS…), the taxes and duties applied will be different: – V.A.T. will be applied on orders for countries inside EU (V.A.T. around 20%). – Rest of the world : import duties and taxes are not included in the item price or shipping cost. These charges are your responsibility and will be collected from you by the carrier upon delivery.
